Under and by virtue of an order of court passed in Civil Action No. C-05-CV-16-000039, titled Hawkins v. Ferensic the undersigned Trustee will offer for sale all the right, title and interest of the parties to the action in the following property:
PROPERTY: All that lot or parcel of land situate in the 1st Election District of Caroline County, said to contain 48.7 acres as illustrated on tax map 2 grid 23 parcel 20. Tax account no. 01-005871 described in a deed recorded 10/01/2004 in Liber 564 folio 392, a Land Record Book for Caroline County. See also plat recorded in Liber 124 folio 099 a Land Record Book for Caroline County.
The property is improved by a 2 story home (currently uninhabitable) a 3 bay garage, several fenced pastures. Approximately 5 acres cleared, the balance wooded. The property has road frontage on Stafford Road, but is accessed by a private lane from Crownstone Road.
TERMS OF SALE:
A deposit of Fifteen Thousand Dollars ($15,000.00) in the form of a cashier’s, certified or approved check shall be paid at the time and place of sale, the balance of the sales price shall be paid by cashier’s or certified check or wire transfer at the settlement, that shall be on or before August 10, 2019, unless said period is extended by the Trustee, or her successors for good cause shown. The sale is subject to court ratification.
Time is of the essence. In the event that the purchaser fails to go to settlement as required, sellers shall retain the deposit as liquidated damages, and the property shall be resold at the risk and expense of the defaulting purchaser. Purchaser shall pay all transfer costs including recordation tax, state and county transfer taxes, agricultural transfer tax (if any) costs for document preparation and recording, title examination, and title insurance.
The property shall be sold subject to all restrictions, liens, covenants and encumbrances of record. Taxes and all other public charges and assessments payable on an annual basis shall be adjusted to the date of sale and assumed thereafter by the purchaser. The Trustee hereby notifies all prospective purchasers that the property is or may be subject to the agricultural transfer tax. Md. Code, Tax Property Article sec 13-201, et seq., which provides generally that property assessed on an agricultural basis may be developed only on the payment of a tax.

The property is being sold in "AS-IS -WHERE IS" condition with purchaser responsible for correction of all environmental, zoning, housing or livability code violations. The Trustee and the auctioneer make or give no warranties, express or implied with respect to the real property, or improvements, including but not limited to: development potential of the lands involved; structural integrity, physical condition, construction, extent of construction, workmanship, materials, physical condition or habitability of improvements; zoning; or environmental conditions; and fitness for a particular purpose or merchantability of improvements.
