RESIDENTIAL (MANUFACTURED TRAILER/HOME) REAL ESTATE
commonly known as 25335 Sandy Point Road, Greensboro, Caroline County, Maryland
Under and by virtue of the power and authority contained in a Deed of Trust from Teresa Lynn Trice, dated December 21, 2012 and recorded at Liber 1034, folio 307 in the Caroline County Land Records, default having occurred under the terms thereof, the holder of the indebtedness secured by the Deed of Trust having appointed Alexis E. Kramer and William C. Chapman as Substitute Trustees by instrument duly executed, acknowledged and recorded among the Land Records of Caroline County, the undersigned Substitute Trustees, will sell at public auction, at the Caroline County Circuit Courthouse door, 109 Market Street, Denton, Maryland on:
December 10, 2021 at 10:00 a.m.
ALL that piece or parcel of land lying, situate and being in the Second Election District of Caroline County, State of Maryland, and more particularly described as follows: BEGINNING for the same at a point on the southerly side of the road 50 feet wide shown on a map of the Olin Griffith and Ruth Griffith property made by J. Malcolm Bye, Surveyor, on September 29, 1965, and recorded among the Land Records of Caroline County, at a point 375 feet S. 84 degrees 30 minutes E. from the intersection of the southerly side of said 50 foot street with the easterly side of a 40 foot street, both being shown on said plat, and on the dividing line between Lots 5 and 6 as shown thereon; and running thence (1) with said division line S. 23 degrees 30 minutes W. 190 feet to the line of lands now or formerly of David Stewart; thence (2) with the said David Stewart line S. 84 degrees 30 minutes E. 100 feet to a point at the southeastern corner of said Lot 6; thence (3) with the southern border of Lot 6 N. 23 degrees 30 minutes E. 190 feet to the aforesaid 50 foot street; thence (4) running with said street 100 feet to the place of beginning, being Lot 6 shown on the above plat and also being part of the same land conveyed to Olin M. Griffith and Ruth W. Griffith by deed of Harry T. Langmaid and wife bearing date the 31st day of July, 1945, and of record among the Land Records of Caroline County in Liber 107, folio 3; and being the same land conveyed by Olin M. Griffith and Ruth W. Griffith to Marie Thelma Mills Trice by deed dated January 13, 1966 and recorded June 30, 1966 in Liber 159, folio 578, a Land Record Book for Caroline County.
TERMS OF SALE: A cash deposit or certified funds of $7,500.00 shall be paid at the time and place of sale, balance in cash at settlement, which shall be 20 days after final ratification of the sale by the Circuit Court for Caroline County, unless said period is extended by the Substitute Trustees for good cause shown; time being of the essence; interest at the rate of 4.260% per annum shall be paid on the unpaid purchase price from date of sale to date of settlement. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser assumes the risk of loss or damage to the property from the date of sale forward. If the Substitute Trustees are unable to convey good and merchantable title, purchaser’s sole remedy shall be limited to a refund of the deposit and cancellation of the sale. In the event the purchaser fails to go to settlement as required, the property will be resold at purchaser’s risk and expense. Purchaser consents to the personal jurisdiction of the Maryland Courts. The property is sold in an "AS IS" condition and subject to covenants, conditions, declarations, restrictions, by-laws and plats, and utility agreements of record, if any, affecting the property.
Taxes shall be prorated as of the date of sale and assumed thereafter by the purchaser. All other outstanding public charges or public assessments, including but not limited to water, rent, front foot benefit, condominium fees, sewer, sanitary and/or City, County or Town charges, as well as any tax sale amounts, costs and/or attorney’s fees, shall be paid by purchaser whether incurred prior to or after the sale. All quantities of land are "more or less," without survey or warranty. Information contained herein is believed accurate but is without warranty. Costs of all recording fees, transfer taxes, agricultural taxes/fees, document preparation and title examination and insurance shall be borne by purchaser, i.e., contrary to those provisions of the Maryland law which would, in the absence of this stipulation, require that recording and transfer taxes be divided equally between the seller and the buyer. Purchaser agrees to pay a reasonable fee for any other services rendered by seller’s attorney at the request of purchaser or due to purchaser’s failure to comply with the terms of the sale.
The Substitute Trustees reserve the right (i) to waive or modify the deposit requirement; (ii) to approve the creditworthiness of any bidder or final purchaser; (iii) to withdraw all or part of the property from sale at any time prior to the termination of bidding; (iv) to keep the bidding open any length of time; (v) to reject any or all bids; and (vi) to postpone the sale, all as the Substitute Trustees may determine in their sole discretion.
